I've had an inquiry by a company for a theft issue. "Money taken out of a purse". No police report was filed and the company wants polygraph exams for 5 employees related to who took the money. I'm torn believing that it doesn't meet EPPA...since it probably doesn't, if an examiner were to conduct the exams with voluntary examinees would it violate EPPA or would it be ok under a theft issue exam period.

If you're doing the exams privately, then you're looking for trouble. The employer has reasonable cause for each of the five employees? I would doubt it.

Barry is right! I doubt that all five are viable "suspects". Additionally, it sounds like the request to take the polygraph is originating from the employer. If so, this has EPPA written all over it!

For the employer to ask for polygraphs the employer must have had a financial loss (EPPA) not an employee. The employee's purse missing money is a criminal issue and the local law enforcement should have been called. You said the inquire was from the 'company' - regardless if the tests are voluntary - I wouldn't touch this one! Taylor
